Three Afya SACCO Officials Charged in Sh40m Heist

Three officials of Afya Sacco Society Limited have been charged with stealing more than Sh40 million from members’ contributions over a period of four years.
Afya Sacco manager Evans Mung’ahu Kola was charged alongside Patrick Kuya Lubako and Mumina Mutinda Ing’ui before the Milimani Law Courts on December 19, 2025.
The three denied eleven counts relating to conspiracy to commit a felony, stealing, acquisition of proceeds of crime, and use of illegally acquired funds.

According to the charge sheet, Kola, Lubako, and Mutinda jointly conspired to defraud Afya Sacco Society Limited within Nairobi’s Central Business District by allegedly creating fictitious deposits and subsequently withdrawing funds from Front Office Service Activity (FOSA) accounts.
Milimani Chief Magistrate Lucas Onyina heard that the accused fraudulently withdrew Sh40,169,165.69 while pretending the transactions were genuine. The Director of Public Prosecutions (DPP) told the court that the money belonged to Afya Sacco Society Limited and was allegedly stolen on diverse dates between April 20, 2021, and January 3, 2025.
Kola, in his capacity as the Sacco’s manager, was accused of stealing Sh40,169,165.69 that came into his possession by virtue of his employment. Lubako and Mutinda were separately indicted for stealing the same amount jointly with another person not before the court.
The court further heard that between April 20, 2021, and January 3, 2025, Lubako and Mutinda allegedly acquired Sh10,714,999.72, knowing the funds were proceeds of crime deposited into a FOSA account. The two were also charged with acquiring an additional Sh24,950,999.97 under similar circumstances.
Kola faced an additional charge of receiving Sh2,801,616, alleged to be proceeds of crime belonging to Afya Sacco.
Lubako and Mutinda were further charged with using proceeds of crime amounting to Sh10,714,999.72 deposited in a FOSA account, while Kola and Mutinda faced a joint charge of using proceeds of crime totaling Sh24,950,999.97.
Kola and Mutinda were also accused of irregularly using Sh1,702,000 belonging to Afya Sacco, deposited in a FOSA account. In the final count, Kola was charged with irregularly using Sh2,801,616, knowing the money was proceeds of crime.
The accused denied all the charges and applied to be released on bond, arguing that they were not flight risks. The court heard that they had cooperated with investigators by regularly reporting to their offices over the past year.
The prosecution did not oppose the bail application.
In a brief ruling, Magistrate Onyina noted that the accused had cooperated with investigators and granted each of them a bond of Sh4 million with one surety of a similar amount. Alternatively, they were allowed a cash bail of Sh2 million each and required to present one contact person.
The matter will be mentioned on January 7, 2026, for pre-trial directions.
